The exact address, characteristics, photographs, videos, plans, certificates, cadastral, registry or technical information and other data necessary to value, prepare, publish or market the property.

Although much of the property information is not personal data in itself, it may be related to an owner or a specific property. Therefore, we treat it with special care.

Economic, contractual or documentary data

When a transaction progresses, we may process data necessary to prepare offers, reservations, contracts, earnest money, deeds, invoicing, fees, payments, ownership documentation, powers of attorney, representation, tax information or any other documentation necessary for the transaction.

We process the data of owners and their properties to value homes, prepare documentation, organize reports, publish properties, promote them, coordinate visits, manage negotiations and, where appropriate, formalize contracts or transactions.

Publish and market real estate

When an owner authorizes us to market a property based on the agreement established between the parties, we can publish property data, photographs, videos, floor plans, features, price, approximate location or area, commercial description and other information necessary for its promotion.

Unless expressly authorized or required for operational purposes, we avoid publishing the owner’s direct personal data. The exact address of the property is handled discreetly and is not usually displayed publicly on the listing.

Legal basis: execution of the marketing commission, consent of the owner when necessary and legitimate interest in adequately promoting the property.

Share properties with MLS networks and collaborating partners

If the owner grants exclusivity and expressly authorizes collaboration, Ketier may share property data with real estate partners or MLS networks, including MLS.es or other professional real estate collaboration networks.

This communication is carried out to expand sales opportunities, facilitate professional collaboration, and improve the dissemination of the property within a controlled real estate environment.

In these cases, the information shared will primarily consist of details about the property and the information necessary for its marketing. The owner’s personal data will be limited to what is strictly necessary and will not normally be shared unless it is essential for the transaction or has been authorized.

Legal basis: execution of the professional commission, consent of the owner and legitimate interest in promoting the marketing of the property within authorized professional networks.

Coordinate photo shoots, videos, plans or technical visits

To prepare for the marketing of a property, we can share the property address with photographers, videographers, architects, technicians, home stagers or other necessary professionals.

As a general rule, we only share the property address and the essential operational information needed to complete the photo shoot with photographers. We do not share any additional personal data about the owner unless it is necessary to coordinate access or if authorization has been granted.

Share contact information with owners or partners

When a person requests information about a property or wishes to proceed with a visit or negotiation, Ketier may share the personal data provided in the form or initial communication with the property owner and/or the real estate partner collaborating on the transaction, whenever necessary to address the request, coordinate the visit, manage the business relationship, or move forward with the transaction.

This communication is limited to the necessary data, usually name, telephone, email, property of interest, availability and essential content of the request.

Legal basis: application of pre-contractual measures requested by the interested party, execution of the professional relationship and legitimate interest in properly managing the real estate application.

Manage advanced real estate transactions

When a transaction progresses, we can process and share data with the relevant parties and professionals: buyers, sellers, representatives, lawyers, notaries, managers, tax advisors, financial institutions, appraisers, Property Registry, Cadastre, Commercial Registry where applicable, public administrations and MLS partners or collaborating agencies involved.

This communication is only carried out when it is necessary to prepare, negotiate, document, formalize, register or execute a real estate transaction.

Legal basis: contract execution, application of pre-contractual measures, compliance with legal obligations and legitimate interest in properly managing the operation.

To provide subsequent services for renovation, decoration or improvement of the property

In certain cases, and always at the request or authorization of the new owner, we can facilitate contact with professionals in renovation, architecture, interior design, decoration, maintenance or other services related to the property.

We will only share the necessary data and only when the interested party requests or authorizes it.

Legal basis: consent of the interested party and/or application of measures requested by the interested party.

To comply with legal, tax, accounting and administrative obligations

We process data to issue invoices, manage collections, comply with tax, accounting, commercial, labor, and administrative obligations, and respond to requests from competent authorities.

We may also communicate information to competent authorities, the Executive Service of the Commission for the Prevention of Money Laundering and Monetary Offences —SEPBLAC—, courts, security forces, notaries or other obliged entities when there is a legal obligation, requirement or indications that must be analyzed in accordance with the applicable regulations.

When authorized by the owner or permitted by the professional engagement, we may share property data with MLS networks, including MLS.es, to promote real estate collaboration and the marketing of the property.

Technology providers

We use technological tools to manage the website, forms, communications, CRM, hosting, security, analytics, email, backups, and other necessary services.

Among these providers is IAGestión, a real estate CRM managed by Semilla Proyectos y Sistemas S.L., based in Avilés, Asturias, which acts as the data processor for the data that Ketier enters into the platform.

There may also be other providers of hosting, web maintenance, email, security, analytics, advertising, forms, or productivity tools.

Photographers, video/3D producers, and real estate marketing professionals

To prepare a property for sale, we can provide the property address and other necessary operational information. Generally, photographers and audiovisual professionals are only given the property address, unless additional information is required to coordinate their work or authorization has been granted.

Lawyers, notaries, managers, advisors, appraisers and financial institutions

As a transaction progresses, we can share data with the necessary professionals to review, negotiate, document, finance, formalize, settle taxes, or complete the transaction.

Public registries and bodies

We may communicate data to the Property Registry, Cadastre, Commercial Registry, tax authorities, municipalities, courts, administrative authorities, SEPBLAC or other public bodies when necessary or there is a legal obligation.

Professionals in renovation, architecture, interior design or decoration

We will only share data with these types of professionals when the interested party requests or authorizes it, for example, to receive help in a renovation, decoration, improvement or adaptation of the property.

7. Data Processors

Some suppliers process personal data on behalf of Ketier so that we can provide our services. These suppliers act as data processors and must process the data according to our instructions, with confidentiality and appropriate security measures.
